A new bill authored by State Sen. Jacque in the Wisconsin Senate seeks to create exceptions allowing certain retired law enforcement officers and firefighters to continue receiving their Wisconsin Retirement System annuities when rehired, according to the Wisconsin State Senate.

According to the Wisconsin State Legislature's official website, the bill was described as follows: "law enforcement and firefighter annuitants in the Wisconsin Retirement System who are rehired by a participating employer. (FE)".

The following is our breakdown, based on the actual bill text, and may include interpretation to clarify its provisions.

In essence, this bill amends the Wisconsin Retirement System (WRS) statutes to create an exception for retired law enforcement officers and firefighters who are rehired or provide services to a WRS-participating employer. Under current law, retirees rehired by a WRS employer must suspend their annuity. The bill allows these specific retirees to continue receiving their annuity if they meet certain conditions: they do not have an agreement to return to work with a WRS employer at the time of retirement, and they elect not to become a participating employee upon rehire. This exception aims to provide flexibility for retired law enforcement officers and firefighters returning to the workforce without affecting their WRS annuity benefits. This provision first applies to WRS participants terminating employment on the bill's effective date.

The bill was co-authored by Representative Chuck Wichgers (Republican-84th District), Senator Rachael Cabral-Guevara (Republican-19th District), Senator Jodi Habush Sinykin (Democrat-8th District). It was co-sponsored by Representative Elijah R. Behnke (Republican-6th District), Representative Russell Goodwin (Democrat-12th District), and Representative Rob Kreibich (Republican-28th District), along seven other co-sponsors.

André Jacque has authored or co-authored another 15 bills since the beginning of the 2025 session, with none of them being enacted.

Jacque graduated from the University of Wisconsin, Madison in 2003 with a BS.

Jacque, a Republican, was elected to the Wisconsin State Senate in 2019 to represent the state's 1st Senate district, replacing previous state senator Caleb Frostman.

In Wisconsin, the legislative process starts when a senator, constituent, group, or agency proposes an idea for a bill. After drafting, the bill is introduced, numbered, and referred to a committee for review and public input. If approved, it moves through three readings and votes in both the Senate and Assembly. Once both chambers pass the same version, the bill goes to the governor, who can sign it, veto it, or let it become law without a signature. Only a small share of bills introduced each session ultimately become law. You can learn more about the Wisconsin legislative process here.
